Right of way
extinguishable
continued

by reason of extinction, any special
damage accrue to any Owner Occupier or
other person interested in any Land contiguous
or nearly adjacent to such land, compensation
shall be made to every party so specially demnified
in like manner as in and by the
said former Act is required to be made
to parties interested otherwise than as Owners as Tenants or Tithe-Owners
in the land to be purchased, as aforesaid: so also [+] in
if there should be any party having a special which manner also shall compensation be [+] in the instance of
land in separate
Ownership, if should any
shall be included in such shall have
been the spot so fixed
upon as aforesaid,
for the purposes of
this and the said
former Act
right of way over such land, such right of way, made to all every party if any, having
may in like manner be extinguished, compensation a special right of way over any part
being made either in kind by the assignment and of a of such
new and sufficient right of way or in money
as above mentioned: so also, if by taking, for
the purposes of this and the said Act, any
piece of ground, lying immediately between
two other pieces of ground and not so taken and
being the property or in the occupation of the
same party or parties as the bear ground
so taken, any material and special damage should be
found to result from such interruption breach of
continuity compensation in money shall be mo either
in kind as in aforesaid or in money shall [+]2 be made for [+]2 by such Feoffee or
Feoffees
such damage to every party so demnified
in manner as herein last above mentioned.
