in the Act —
That the portion thus leased to the Crown
be charged with the obligation of receiving
Rubbish: & that the portion, reserved to the
Dean & Chapter, be discharged from every
such obligation, should any such be found
to exist. —
That the consideration money or rent
to be paid for the portion granted to the Crown
be invested in the hands of Trustees, to abide
the issue of the difference existing between the
Dean & Chapter on the one part, & the Parish
or Parishes on the other part, touching the
extent of their respective rights, in relation
to the Waste in question. —
That, to save the expence & delay of a
Chancery Suit, on a ground of such intricacy,
& in which such a variety of evidence, antient
& modern, written & oral, may require to be
investigated, produced, & commented upon,
a clause be inserted for submitting all such
differences to arbitration —
9 — That a valuation be made of the whole
of the Waste, including as well the reserved
portions as above as the portion proposed
to be leased out to the Crown: & that, if the
share adjudged by the award to belong to
the Dean & Chapter be greater in value than
the part hereby proposed to be reserved to their
use in kind, a proportionable part of the pecuniary
