realized, would be rendered almost imperceptible
as far as the Parishes are concerned at least,
by the multitude of the sharers. The possession
in question, in as far as it pretends to independency,
was, it is true, according to every
appearance, founded originally on usurpation.
But even in the strictness of Law there is a
period, & that perhaps in the instance in
question not very far distant, at which usurpation
becomes converted into a right: & the
hold, it cannot be doubted, would be considered
as much stronger, when opposed to adversaries,
whose application would be for favour not for
justice.
7. Even supposing all the above difficulties
surmounted (& those in particular which concern
the Buildings in question, by consent
for instance, or otherwise) it would then rest
with the wisdom of the Dean & Chapter to
consider, whether after refusing a concurrence
applied for on the footing of a favour, tho' on
the part of Government, & on terms in the
framing of which no want of attention has
been shewn to the dignity of the reverend body
any more than to its substantial interests,
they could within the compass of any very
short period come to the same Government,
either with much grace, or with any very promising
probability of success, with an application
on their part for a favour, on terms
dictated by the sole consideration of particular
interests, in contradistinction to those of
the public at large.
