Plan for Division of Tothill Fields Considerations

Considerations
in behalf of the above plan

1. The opportunity, which now happens to present
itself, affords the only prospect which the
Dean & Chapter seem to have before them of devising
any sort of benefit from the Waste in question, unless
it be by the event of a Suit in Chancery, a contention
which, under a continued series of provocations, they
have had the wisdom & temper to keep clear of for
a long train of years, & the issue of which, how favourable
soever, could not, according to the ordinary course
of such proceedings, be reasonably expected to have
taken place, before the greater part of the reverend
body would according to the common calculations
of the probabilities of life, be in their graves.++ A computation confirmed
by several
gentlemen of eminence
in the profession to
whom it has been
communicated —

2. The difference being so great between the
notions entertained on the subject of the rights in
question, on the part of the Dean & Chapter on the
one hand, & on the part of the Parish or Parishes
on the other, it seems morally certain, that any
plan which could be formed by the Dean & Chapter
for the improvement of the whole of the Waste,
or any part of it, would be opposed in Parliam:t
by the Parish or Parishes: in which case Parliament
could not, in the common course of proceeding,
or even in common justice, accede to an
application for that purpose, till the repugnant
claims had received a determination in course of
Law.

3. On the same account, it seems equally improbable
that any application for a similar purpose should
originate with the Parish or Parishes, on any such
terms as would be thought proper to be acceded to
on the part of the Dean & chapter —
