hundred and ninety four for and concerning the purchase
of Grounds for the purpose of erecting and establishing a
penitentiary House or penitentiary Houses with the
Appurtenances thereof shall extend And the same are
hereby Declared to extend mutatis mutandis not only to
cultivated and other Lands in severalty or separate
Ownership But likewise to Lands in the state of Waste andwhich maybe subject
to rights of Common Laws Insomuchand that for the purchasing Ground
proper and convenient for the said purpose the Lord High
Treasurer or Commissioners of the Treasury may at his or
their discretion fix upon a spot of Ground either consisting of
Land in separate ownership solely or of Land solely in the state of
Waste and Common Land solely,subject to rights of Commons upon which or of Land partly in separate
