time being of the said Parish of St Johns on the 3d part shall
within the space of one Calendar Month after such Notice respectively
declare in writing their acceptance of such Price Then and in such
case it shall and may be lawful to and for such Feoffee or Feoffees
at any time thereafter to enter into and upon all or any part of the
said Parcel of Land marked A for the uses and purposes of the
said Act of the 7 day of July 1794.
And further that if any one of the said three Parties
shall for the space of one Calendar Month to be computed as aforesaid
have omitted to declare their acceptance as aforesaid, or shall have declared
their refusal to accept the said Price Then and in either of the said
cases the said Feoffee or Feoffees shall cause the value of the said
lot A including the said commonable Rights &acept as aforesaid to
be ascertained by a Jury pursuant to the Directions of the said Act
of the 7th Day of July 1794 and thereupon if the sum of Money assessed
by the Verdict of such Jury to be the value of such last mentioned
Parcel of Land shall not be greater than the sum which shall have
been paid into the Bank of England as aforesaid, Then immediately
upon the giving such Verdict it shall and may be lawful to and for
such Feoffee or Feoffees his or their Workmen or Agents to make such Entry
as aforesaid, or if the Sum assessed by the Verdict of such Jury shall
be greater than the Sum which shall have been paid into the Bank
of England as aforesaid Then upon payment into the said Bank
of the difference between such greater Sum and Sum which shall
have been paid It shall and may be lawful to and for such
Feoffee or Feoffees his or their Workmen or Agents to make such Entry
as aforesaid and to hold and enjoy the same Portion of Land in
fee Simple discharged of and from all the said Commonable Rights
and other Rights whatsoever except as aforesaid and others than
and except such Rights as are hereinafter reserved to the said Dean
and Chapter and their Successors—
