Tothill Fields Inclosure Bill §. 13. —
Vacancies among Commissioners
supplied. —

Provided always And be it further Enacted that
from time to time on the Death Resignation Refusal to act or Incapacitation
of any one or more of the Commissioners or Arbitrators to be appointed
from time to time as hereinbefore and hereinafter is mentioned It shall
and may be lawful to and for the Party or Parties respectively by whom
the Commissioner or Commissioners Arbitrator or Arbitrators respectively
so dying resigning refusing to Act or being incapacitated as aforesaid
was or were appointed to appoint another Commissioner or Commissioners
in the place of the Commissioner or Commissioners respectively so dying
resigning refusing or being incapacitated to Act as aforesaid and further
that upon Notice in writing to the surviving Commissioners or Arbitrators
of the Decease of any other or others of the said Commissioners or Arbitrators
such surviving Commissioners or Arbitrators shall at their then
present or first meeting on the request of the Party or Parties whose
Commissioner or Commissioners shall be so dead provided such request
shall be made adjourn for any length of time desired in and by
such notice and not exceeding a week for the purpose of giving time
for the appointment of a new Commissioner or Arbitrator Commissioners
or arbitrators in the Room of such deceased Commissioner or Arbitrator
Commissioners or Arbitrators Provided always and is hereby
enacted and declared That no appointment of any Commissioner to be
be nominated by the said Dean and Chapter shall be determined
by any Vacancy in the said Deanery and that no appointment of
any Commissioner — nominated by the said Rector of St Johns
shall be determined by any vacancy in the said Rectory.

Provided also and it is hereby enacted and declared that from
to time in case of a Vacancy of the said Deanery or a Vacancy of
the said Rectory the right of appointing a new Commissioner or Arbitrator on
