§.3 Plan of their defence

In the part Part next ensuing it may be afford
some assistance to conception, of the reader is put previously
into possession of the course taken to shew from the very nature
of the case the impossibility of the design and
thereby of the evil pretended to be apprehended by some pretended
to be apprehended by others, and thereby of every such design
as that of giving birth to it. This course will be shewn
by the following topics, which will be seen forming the heads
of so many sections

1. Condition necessary to the existence of the imputed
design that concurrence impossible.

2. In equal shares, general partition of unmoveables impossible

3. In equal shares, general partition of moveables impossible

4. In equal share, general partition of property in any other shape

5. impossible Determination as to who shall be sharers impossible

6. In any other than equal shares generalpartition of property
in every shape impossible

67 Concurrence in any other plan of general speculation
impossible

8. Concurrence in the part of any constituted authorities
necessary but impossible

9 Accomplishment being manifestly impossible, the
design is impossible.

10. The talked of spunge afford no proof of any
such design.

11. Hard case of the parties accused.
