Of Punishments
Banishment from the presence of any person (suppose the ) the party
injured admits of two degrees. 1. Where the
party injured being already in a place, the offender
is not to come into any that place. This is the
lowest degree. 2. Where the offender being already
in a place, the party injured by upon coming
& finding him there may oblige him to depart.
This is the highest degree.
Both degrees are subject to the following
limitations. 1. The offender is not to It shall
not be in the power of the party injured to
drive the offender 1. From his (the offender's)
own house. 2. From his Parish Church.
3. If he possesses any office, or own From any place in which it is necessary
he should be in order to execute the functions
of that office. 4. From any place
the departure from which he could not depart
without his or some other person's sustaining some specific pres personal
or pecuniary damage: for instance an Inn
upon the road; there being no other Inn near
at hand at which he could get refreshment: or
a place at which it was necessary he should
be in order to receive money for himself or another person or to earn his livelyhood.
