Descent of property
in case of
perpetual punishment

When any person is sentenced to perpetual
confinement & Hard Labour wha what remains of his effects &
all his rights beneficial & fiduciary shall pass from him
descend to his representatives in the same manner
as if he were dead.

So if he were sentenced to perpetual
Imprisonment: but in this case the Judge may
appoint him a certain allowance out of the
said effects.

The Judge upon assigning a particular
reason may in such case suspend the disposal
of the effects: for instance the expectation of evidence
tending to an acquittal or mitigation: or
the expectation of further claimants.

Power to make
a Testament

The Court may also indulge the criminal
with liberty to make a testament: but not all
after seeing and approving it.

Dissolution of
Marriage

The sentence of perpetual punishment
if the offender be married, his marriage is of
course dissolved: unless the Court for several clauses
postpone the dissolution.
