in some degree to moderate his resentment any indignation that he
may have conceived, if he reflects that to at least I do not add the blame
of obstinacy to that of error; that his bare disapprobation
is unsupported by any reason, were I to know of it would
be an argument with one against the adoption
of the measure I have found myself obliged
to <hazard – the proposal of, and perhaps
even a divisive one: and that the measure he disapproves
of so warmly, may by the time he
begins comes to think of it, be none of mine.

To form a well-grounded and candid judgement
of the propriety of any mode of punishment here proposed
there only method in that, is but one method, which is thi : first
to examine the general principles I have laid down
for determining the choice of punishments as
well in point of quality as of quantity, &
if no fault be found in those principles, then
to observe how far the particular punishment
proposed in the case in question is conformable
to them.
