Of Punishment in General
apprehended he would be punished with simple death: if he
could suffer no more than simple death in case of his committing
more murders, there is nothing to deter him from
committing any number of murders which appear likely to
contribute anything towards facilitating his escape.
Ignominious punishment

cases not to be repeated
But in cases in which ignominious punishment if applied,
if a man commit at different times different offences which
are so far of the same kind as that the ignominious punishment
belonging to them is of the same kind before he can be convicted
of any one of him, it need not be inflicted more
than once.
Reasons
1. It might become troublesome to inflict the same
kind of ignominious punishment perhaps ten or twelve
times running upon the same person; and the effect of the
infamy would be rather weakened than increased by such
frequent repetitions.

the degree of delinquency and the degree of punishment (in
