C9. Of Punishments In General.
22.
When of two or more punishments the choice is given
Convertible Punishments
may
be mixedto the Judge he may mix them in what proportions he pleases:
provided that in the case of chronical punishments he
shall not make any addition to the longest term that is
appointed for any of them. As if he have the power of
choosing between simple Imprisonment for three or four
years and Confinement to Hard-Labour for three Years.
He may if he thinks proper confine the Offender or Hard-Labour
for Three Years and then imprison him for one
Year more: but not for any longer time.
23.
No person who is a Gentleman shall be punished by
Gentlemen take
confinements to Hard-Labour,
in certain cases onlyconfinement to hard-labour, except for the following offences:
to wit, 1. Theft. 2. Fraudulent Obtainment Sharping. 3 Fraudulent
4. Forgery for lucre. 5. Robbery. 6. House-Robbery by Night.
7. Murder for lucre. 8. Incendiarism. 9. Criminal Inundation.
In other cases where an ordinary Person is confined to Hard-Labour,
a Gentleman shall be imprisoned. Pecuniary
