C Of Punishments In General.
Offender in no case be permitted to retain the pecuniary
Profit or any the least part of the pecuniary profit he has
made by the Offence; therefore if it appears that a profit
to such or such an amount and no more has been reaped
from the offence, let the parties be obliged to refund
to that amount; if the amount does not at first appear
let the Judge leave no lawful means untried till he has
satisfied himself what was the amount.
Example..As if a Minister of Justice endeavouring to search
a Man's House for contraband good is forcibly presented
or opposed insomuch that he can neither seized them
nor ascertain what quantity of them there is. In such case
the Offenders might be a gainer by his Offence, if he was were
only punished by for the opposition given to Justice. To present
this let him by all means be made to discover
what quantity of such goods these were.
