Of Punishments In General
A Fine
proportioned to a
man's Income how
to be reduced to a Sum
certain.
Wherever the Sum of a man is to be made to pay
in the way of punishment is determined by its proportion
to his Income or fortune, in order to reduce it to a
Sum certain the Judge shall thus proceed. 1. He Shall Let him
pitch upon the sum certain and propose it to the prosecutor
and the Defendant. If they both acquiesce that
shall be the Sum: If the Prosecutor allege that it is too
little, he shall be allowed to produce proofs and arguments
tending to show why it should be greater; but he
shall not be at liberty to examine the Defendant: The
Judge shall thereupon either adhere to the same sum or
propose a greater; if the Defendant allege that it is
too great, the prosecutor and the Judge may in that
case examine him concerning the amount of his Income
or Fortune, and in general respecting the state of his pecuniary
circumstances [present and] probable, as well
as present.
