Of Punishments In General
An extra-punishment is a punishment added [to
that the lot of punishment appointed for the ordinary
offence] on the score of [some] aggravation [with which
it is attended.
Where no special extra-punishment is appointed
the On the score of aggravation no kind of punishment
can be added to those which are appointed
for the ordinary offence, unless it be specially provided.
The punishment may be severer in degree, but no
different in kind.
But When the quantum of punishment
has been once set, the Judge upon petition with consent of the
offender may if he thinks proper commute the same
or any part thereof into a punishment of a different kind. The use of
this is to enable the Judge in certain cases to adapt
the punishment better to the circumstances of the case
and of the parties interested, than can be done by a general
provision. In this case for the purpose of appeal the
punishment In this case if there be any apt first appointed declared
shall be the punishment to be appealed from. And
in case the offender does not consent, the Judge
can not enhance the punishment first
declared.
