Of Punishment in general
Indelible corporal punishments are such those which whereof
the produce such an effect on the body of the offender
as is designed to last for ever.
All afflictive corporal punishments are ignominious.
No kind of confinement is to be deemed
ignominious; not even imprisonment, nor
confinement to hard labour.
Pecuniary punishment is the obligation
to from yield money. Quasi-pecuniary punishment
is the obligation to yield any other kind of property
that is to be had for money – Whatever
is said concerning pecuniary punishment shall
be applied to quasi-pecuniary, unless the contrary
be expressed.
Compulsive punishments are those which are
specially calculated for compelling a person to do
something which it is in his power to do and which
due to the punishment is instantly made to cease.
By Most punishments might be made in some degree
to answer this purpose, but the punishments particularly here
thereunto adapted designed by that name are two: viz. Dungeoning 1. dungeoning
and 2. the water-torture.
