Whether the Sovereign has a right to inflict death
an idle question
It has been made a question whether the Sovereign has any right to employ the punishment of death. The same question might as well be applied to any other mode of punishment. As well indeed might it be asked whether any one man has a right to govern any other. All these questions are anticipated and absorbed by what is and relative to the principle of utility.See Introd. Ch.1. They sum all of proceed from no other cause than the want of a determinate idea to annex to the term right.
