Ch. Preventive remedies (direct and indirect).
☞ On the score of preventive intention, admission gives
to an unwarranted act of power exercised by an individual
in the character of a ground of Extenuation, where it can
not be received in the character of a ground of Justification.
Anteced Attached to every species of offence considered as
consummated, as a chain of correspondent offences
considered as being with reference to such consummated
Offence, so many Offences risking as yet in tendency,
Offences risking in tendency are either preparations and or
attempts or both.
Considered after the first act or even after the first
moment of the act or of the first act as the case may be every offence
which by reason of the continuity of the act in any sense
is continuous may as to all the evil that remains as yet unconsummated may be taken for the subject of a preventive
remedy. And it thus it is that the topic of
preventive remedies coincides with the next topic
to wit that of suppressive remedies are continually
coincident.
