Two important divisions – both of them exhaustive
both of them of the highest importance, demand on this
occasion the attention of the legislator.
1. The offence thus becomes no matter how continuous
may be either these Official or Official or Non Officials.
It is Official in as far as a any member of the Official Establishment
armed with the power of causing or contributing to
cause the evil in question so far as is necessary for the execution
of his office, a bears a part in the offence.
It is Non Official in as far as the offender is not considered as
not situated seated in any such office.
On the part of a member of the Official Establishment
the act supposing it illegal is an Abuse of power: viz
of the power attached to the Office. See Offences against
