Clause 22. This Clause is of great importance: as no Bill perhaps ever enacted so
many provisions calculated to meet such a variety of Frauds, misdemeanours
and Felonies with a view to detection, prevention, and punishment.
In like manner, no System of Legislation in its execution, ever required so
much method and energy as well as constant and unremitting attention
and hence arises the Idea of Selecting one Magistrate for each District
(to be selected and appointed by His Majesty) for carrying the act into
execution. —— The Districts will depend upon Local circumstances,
and the Magistrates to be chosen will of course be those from whose zeal
attention and activity of mind (heretofore manifested) the most is to be
expected. — An Act of this sort should be vigorously and accurately executed,
if not it would be better that it did not pass into a Law. — It is a System
destructive to the Interests of the fraudulent many of whom possessed
of a considerable property will no doubt make every exertion to defeat
the ends of Justice: It is therefore necessary that the exigency of the Case
should be fairly met, by investing Magistrates with a power in a prompt
and decisive way to enforce the regulations or punish their non observance
thereof, that the Public may be protected against the multifarious frauds
and embezzlements which have by their Gradual and extensive increase
of late Years proved so injurious to Society.

When responsibility attaches to persons undertaking any
particular Duty it is done with Promptitude with Zeal and attention:
When such responsibility does not attach and when it is the business of
more than one the energy of action is generally lost to the Public. What
is the Business of every one is the Business of no one all in such Cases
will do a little but it will seldom happen under the present
Circumstances where very particular exertion prudence discretion
and good Judgment are required that those advantages can
properly attach to more than one properly qualified responsible
Magistrate and it is with this view that this particular Clause
