when it is also considered that infinitely greater powers are given every
Session of Parliament to Magistrates it would seem that the objection when
put in competition with the utility would not have much weight. It might
be expedient perhaps at present to give up the Idea of Inspectors and also
that Clause in the Bill which requires a Certificate of character and
merely to empower the Magistrates to grant Licenses without requiring
even any Security as in the Case of Victuallers. But even with all these
Disadvantages the Single Circumstance of a Mans License depending
upon the will of a majority of the Magistrates would have a wonderful effect in
preventing innumerable frauds and Irregularities which would unquestionably
take place in spite of all the vigilance that could be exercised
if such Licenses could be demanded annually as a matter of right.
For it is notorious that at the Stamp Office the Circumstance of a
Man having been convicted of a Crime which is proposed by the amendment
to constitute a Disqualification, would never be attended to by the Persons appointed
to grant such Licenses and hence it will happen Year after Year that the
most notorious offenders would be authorised to cheat and defraud the Public.
Nor would it be possible for Magistrates to check the mischief if their attention
is not annually directed to that particular object upon the whole therefore it
would seem that the advantages likely to result to the Community from this
regulation would greatly counterbalance any Inconvenience that may arise
from it. And in order to render the measure Palatable to the Public and to
prevent the possibility of corrupt Magistrates acting in General Session
from indulging Pique or Ill will against any particular Individual applying
for a License a Power may be granted to all who think themselves
aggrieved to appeal or apply to the Quarter Sessions for the purpose of
having their Case considered and as further check upon the Power of the
Magistrates they may be restrained from </del>negativing the application of
any person for a License unless such Person shall have been convicted of
any Offence against the Provisions of this Act or of any Felony Fraud or
Misdemeanour or who not having been convicted of any such offence
