of the act of the 29th of the present King Chapter 49 there is an exception
under a description of Carriages in which the words not generally used for the
purpose of Husbandry &c or for the Carriages of Goods Wares and Merchandize
in the way of Trade form an exemption from the Carriage Duty
and it is submitted whether some such similar words might not be
introduced to ascertain the Description of the Carts to be exempted from
the License Duty proposed by this Bill or nather such Carts as shall
not subject the owners to the Penalties inflicted by the Act. This difficulty
however if any exists can easily be removed by the aids of that legal
Knowledge and experience which will be employed in correcting the
Bill. The object of regulating these Carts is so important that it would
not be expedient to abandon it if by any means a Line could be drawn
to protect the innocent against the Penalties

In the restriction of Clause 15 as to the Hours of dealing.

Answer

In reflecting upon those particular restrictions it is necessary to recur
to the former observation that was made namely that those Hours were
suggested by the Dealers themselves who were consulted upon this Bill
grounded on their own Knowledge that the chief business was done in
the dusk of the evening and it was proposed also upon this principle
that by prohibiting such Dealers from lighting Candles at all or in
other words from doing Business by Candlelight a readier means of
detection was established in as much as it would give power to the
Officers to enter such Licensed Shops as other places which appeared
to be lighted up. It seems however clear that this restriction can only
extend partially without great hazard to its being considered as a
grievance calculated to excite much clamour and it is equally clear
it cannot extent to Pawnbrokers who are allowed to transact business
till nine oClock in the evening and perhaps it would be equally
hard to restrict the Dealers in wearing Apparel to such early hours
as well as the wholesale dealers generally; so that upon the whole it
would seem expedient that the hours should be extended, perhaps
from 8 in the morning till 8 in the evening without any distinction between summer and winter.
