part of this Conduct which is connected with a vigilant and energetic Police. At
present it is to be lamented that the System though well imagined is not executed
with that fidelity and Security to the Public which the enormous expence attached
to Watchmen and Patroles entitles the Community to expect.
A superintendance under the controul of Magistrates by means of discreet Persons of
Sober Life and Conversation would have a wonderful effect in checking many
of these enormities as well as gross neglects which are practised through the medium
of officers of the Night Watchmen and Patroles and until some Superintendance
of this sort sort is established the utility of this very expensive Establishment
can never be made effectual in this Great Capital. While it is the Duty of
Magistrates by the common as well as Statute Law of the Country to take
Cognizance of all matters relative to the Peace and good order of Society there seems
to be an incognity in those regulations which do not place in their Hands the
Jurisdiction or Superintendance of those Officers who are appointed to protect
the Public against disorders irregularities and Crimes during the Night. The want of such a power especially since a purer Magistracy has been established
in the Capital is one of the Causes why many enormities continue and many
Impositions are suffered which would otherwise be supressed. There certainly
can be no good Sense in intrusting Magistrates with very extensive powers
in all matters relating to the execution of a vast body of Statutes now in existence
connected with the Peace and good order of Society and at the same
time crippling their exertions by weakening or not giving sufficient power and
Jurisdiction over those Officers assigned to assist them in Keeping the Peace.
While therefore this Bill is meant to operate as a great System of prevention
it is humbly submitted whether in order to that System it would
not be proper to introduce some well digested Clauses applicable to the object
of establishing a more effectual Controul over Parish Constables Headboroughs
Watchmen and Patroles exercising their Duty in their night. Such
controul would have a very beneficial effect in exciting that degree of
Vigilance in the detection of offenders and in the prevention of Oppression
and abuse of Power exercised by those Persons while upon their Duty, for it
