The degree of inefficacy but too observable in the
penal branch of our law results in more ways than
onee from the inordinate severity of it: directly is the
unwillingness of individuals to contribu lend a hand to
the execution of it: indirectly; by the contrivances preferences invented
by lawyers from for shutting out evidence which
under a milder system of punishment could men would
not have been so fearful to receive.
