It seems Nor does it seem an arrangement easily reconcilable
to that candour and good faith that which should
characteristic every act of government, that
while the legislative and the judicial departments
each in their its respective sphere, are measuring
out distinctions, the executive branch, scarcely or
rather avowedly, shall have determined there
shall be none some: and that those who by law
are banished for limited terms, should shall in point
of fact and by an extra-judicial decision be
banished for life. The injustice (if it may be so termed) is not universal:
is indeed not universal but just in as far as it fails of being so, universal
just so far
it fails of the security which it aims at is
at end does Government fail of obtaining that security which at this
price it would be content to purchase at this price.

A number linked together in iniquity, the
poor with the rich, as pirates have so often been, might
at any time, if their savings abroad or acquired trades original or acquired or connections

vessel from hence hence, or build one there, and return
from thence in a body, upon a plan of foreign piracy or
domestic depredation. Their passage not being terms being expired, and their
undeclared purpose undisclosed, no authority
in the Colony could prevent them, without barefaced
oppression and injustice.
