8. That, on this occasion, he sensing it may be
proper for him to mention, that by way of justification
for the said Mr Fonblanque's declared determination
not to quit possession as aforesaid, his said Clerk
observed alleged that the said notice was void to law, inasmuch
as the tim day therein appointed for quitting possession
was neither the same day of the year in which
the possession commenced nor the day of the expiration
of the intervening half year. But to this Your Petitioner
answers (protesting thus in point of fact the said possession
did not commence on any quarter day but in the
middle of a quarter) to this Your Petitioner answers
that admitting such to be the law in the other cases, if as
as for example in the case of a farm, the obligation
has no application to a lodging of any kind, and nor
in particular or at any rate – that it has not under the custom of this Honourable Society
application to a set of Chambers.
But for as to this point (requesting if necessary to be taken
on the question of fact, as above) on viz as to be the point of law, Your
Petitioner begs leave to refer & submitt to refer the same to the
wisdom and good pleasure determination of the Honourable Bench,
hoping at the same time, in the event of its being unfavourable
in this to Your Petitioner, hoping, for their mediation
in interposition with the said Mr Fonblanque, in
such manner that Your Petitioner may re-obtain
possession of the said premises at such other time as
be their to the said Honourable Bench in its wisdom and justice may seem meet.
