such Lands those should chance to be any timber
growing at the crux of the passing of this Act the Commissioners
hereby appointed to be appointed in thereof shall in setting out the respective
portions of the said Commoners in severalty have
regard to the value of such timber and the
preservation thereof: and, if the said timber should
appear to belong of right to any other person than or persons
other than the said Commoners, + to carry one or
+ shall thereupon awardshall in consideration
therefore & thereof award to such
owner or owners a
satisfaction in money
as a compensation for
the same at the expense
of the said Commoners
in proportion to the
values of their respective
interests:as if
such timbers should
appear to belong

more of the said Commoners to the exclusion of
the rest, shall in such case then award a compensation to
such commoner or commoners being owner
or owners of the land such timber either in money at the expense of the
rest, payable as just mentioned, or by proportionable
increase of his or their several share or shares of the said
land: they the said Commissioners having special
regard to the preservation and most beneficial allottment
of the said timbers as aforesaid. And of
persons who if any person or persons shall + and in order to defeat
+ malitiously and in contemplation
of any division
made or begun or
intended to be made
of such lands under
this Act

the intentions of this Act the same in respect of the preservation
of such timber as aforesaid shall injure or
malitiously cut down, destroy or injure damage the same, every such offender shall, notwithstanding
any such title or portence of titleas aforesaid.
suffer in like as any person so offending and having no such
title or pretence of title may be made to suffer under
any Statute or rule of Common Law was being, or which
at this time of the commission of such mischief shall be, in force
