§. Remedies indicated

The main object is t in ca in causing the main the national object – is
in the case where the capture prize turns out to be of small
value, as also in cases where without blame on his
part a Captor would by an adverse decision be
loaded with costs, to exonerate the Commander from
by which those apprehensions by which, in the ordinary course
of things, a man in his situation would be deterred
from doing what depended upon his exertions towards
the protection of our own fra property and our own naval force
and or the reduction diminution of that of the enemy, as the case
may be.

Thus for this or any other purpose and reduction defalcation
would be suffered plan, involving in it any the smallest a defalcation
from any such the official profits as have the sanction of
usage, would be endured, ought not to be expected.

The only resource then is to form for
the payment of costs in the case in question a fund
which the burthen of which in the sort of case in question shall not bear upon
Captors in the sort of case in question nor yet upon
any persons in office.
