In the high-day of exultation and gratitude, the
sea-faring man whom the donation first found in the
situation of captors would never harbour would never think of be capable
of harbouring any such wayward thought, as that of taking the
business out of the one only hands of the only persons individuals who
had had any experience in it, and who, as above,
would naturally appear to them in the character be presented to their view in the light of
benefactors. The precedent was thus established.
To draw his decisions from reason or from precedent
and under favour of by the help of that double fountain, to pronounce
on each occasion that decision which was
most convenient and agreeable to himself suitable to his own views belonged upon
that occasion, as under the dominion of Common
alias Judge-made law it drew upon most occasions
to the Judge. In these two associates in office things Officers,
the Judge beheld – every such Judge but for some casual
cause of difference would behold two associates, intimately closely
bound to him linked to himself by the tie of one common
official interest and that as in all fee-fed offices
a sinister one. Under those circumstances Come when he would the discontented
innovator who should say This that I lay claim to is no money of the Kings
it is money of my own money that I beg to earned at the peril
of my own life let suffer me to appoint agents of my own agents for the
recovery of it, the Judge could hold but one language the language of the Judge would naturally be –
⊞ ⊞ After the never-failing usual panegyric
in the matchless virtues
of the individuals who
ever they happen to be. No such things. These and no others are the Agents I am in use to
have to do will hear: these and no others is it is is my pleasure to hear. These These (he would continue)
and no others are the persons whom whom I find fixed in the possession
of the business by the practice of Court: and this is among the cases in which the practice of the Court makes
the law.
