"It is thus" (continues Dr Browne the learned Doctor)
to general observation, applicable to those drosts, that they
like all other grants of the Crown, are to be strictly construed against
the grantee, contrary to the usual policy of the law, in
the consideration of grants": "And here then we have not
only this exquisite line of demarcation but a kept up, but for the
better and more effectual construction of it, a the choice proposed
between three principles of construction i.e. of interpretation, the one proper one,
and two improper ones, one of each side of it.

Were it not for that a corruptive state of things by which
the interest of almost every man who has power continues is placed
in a state of opposition to his duty, where is the man
to whom for for a correct and compleat rule of action the draught of a compleat and at the same time compendium and well contrived body of laws
in so a subject of such vital importance to the
whole community as well as to this necessary extensive part of it
than the learned Judge⊞ ⊞ on whom, instead
of the merited admonition,
an elogium
so perfectly destitute
of all honest ground
is bestowed, so unworthily undeservedly commended. But
as matters stand at present, we see of what sort of fruits
rare talents supported by pre-eminently extensive learning
are productive.

The encouragement given afforded to that branch of military
service is to be regulated not by considerations drawn from the
present interest of the service but by practices supposed
to be in use among men in power ages centuries ago, and those
practices not having even for their objects the interest either
of that the whole community or so much as that particular part of
it, or in short any other object than the interest or the humour
of the persons by whom the acts deeds were done.
