Defence or Prizes
In all those cases in which, whether in regard to the
quantum or in regard to the fact of damage or in regard to
the quantum of damage, the proof is rendered matter
of difficulty, encrease is given, and that in proportion
to such difficulty to the danger of waste and misapplication
partiality and corruption on the part of the hand or hands be they what they may, in which the
application of the matter of reward to the purposes in
question is reposed.
The politics of the captor are they on the right side?
– proof how slight soever will be satisfactory. Are they
on the wrong side Justice and the sentimental regard this to meritorious
service will command the allowance and apposition the
amount.
Those same politics are they on the wrong side. Justice
will still be the presiding virtue, but Economy will
be the Monster in whose Report how will ground
itself.
On the part of great characters in high situations
that is to say on the part of any characters whatsoever
in the same high situations, Virtue never has been, never
can be wanting. On such occasion The only difficulty decision which presents
any difficulty is in which of all her bright
stripes she shall cloath herself.
Under the existing system of despotic arbitrary remuneration –
or rather waste and corruption in pretence of remuneration,
these difficulties appear too great to be contended with.
But under the system by which despotism is excluded
from the operation of remuneration as well as from that of punishment, under
the system by which that trial and that publicity is applied to the
disposal of the matter
of reward, which is so
universally acknowledged
to be due in the case of
punishment, the footing
on which this difficulty
would be found to stand might be very different.
