☞ Add "Fortress on land" the expression is not comprehensive enough.
Suppose Vessels &c lying in one unfortified spot.
Sect. 4. In Part 1. of the same case in which power is reserved
to the King to determine proportions by Instruction
under his Sign Manual, at default of such Instruction
it gives power to "the respective Commander in Chief
of the fleet and of the army employed to make agreements
in writing for the division of the Ships goods," &c: "which agreements"
notwithstanding the powers are not to be "binding"
useless untill" approved by his Majesty "and the
share assigned to the fleet by" (any) "such agreement shall
be distributed therein according to his Majesty ,
and the share assigned to the Army shall be
distributed amongst the Officers and Soldiers in the proportions
correspondent thereto.
2. Next a comes a Proviso to prevent saying
that the Army shall not share in the any Ships, Goods
&c captured in the voyage to or from such fortress.(a)
(a) Proper or improper it seems not very easy to reconcile
this proviso in §. 4, with the first provisions whole tenor of in §. 2.
"With the persons mentioned under by the name of Seamen and five those other classes of viz. Off
Soldiers are to share in all Ships &c taken, and
this without exception – restriction.
