Service §. 7. Boats now first
The difference in the description given of the article is between
this and the preceding Sections, viz. 1 Vessel. 2. Contents of do.
N.B. Prize given to the enemy to the of salvage.
Of Section 6, mention will be made presently.
Section 7th. This Section throughout as well as §. 21 relates exclusively soley
alone as also §. 8, in part to the subject of salvage.
1. Service recapturing a Vessel taken by the Enemy.
2. Source of encouragement the Vessel so recaptured.
3. Relative quantum of the encouragement a proportion
of the value of such recaptured Vessel with its contents:
viz. to King's the if the capturing recapturing Ship be a
Kings Ship 1/8th part of the value of the Vessel and
contents: if on the recapture a Kings Ship and a Privateer be concerned
together, then are such proportions as the judicatory
shall determine: the judicatory, for the guidance
of whose decision no principles or other lights in any shape
are here attempted to be given, so that here the parties
being in this case three, are by the power ingenuity
of the man of law not enticed for forced into
his net.
At the end of this Section comes a clause by which
in case the Vessel so recaptured should shall before such recapture
have been "set forth as a Ship of Vessel of war"
the it is to go as a prize to the captors nothing
being in respect of it, restored to the owners.
☞ Add a note on the hardship to the Owners in this case.
Bring to view the precedents that plead in favour of some allowance
at least to the Owners. If less than after deduction to a
certain amount (say 1/3 as in case of ) the remainder
would be sufficient to produce adequate existence, make such
deduction in behalf of the Owners.
