Prize
Proper or improper in itself, it seems not very altogether easy to
reconcile with the whole tenor of the preceding Section, Section 2,
the particular provision thus stuck into the belly
of Section 4. with By Section 2, wherever any
"Vessels of war in his Majesty's pay" or "by his Majesty's
armed Ships", Soldiers being on board thereof a Ship with goods in it and
so forth is taken, Soldiers are as well as Marines
and Seamen are to have their share: wherever
taken, no restriction in respect limiting of the place where
taken being applied inserted, wherever taken, therefore if for example upon
the open sea taken in the course of a cruize.
But by Section 4, if they being on board a vessel
forming part of a fleet employed in a conjunct expedition
having for he object the capture of a fortress on land
in that case and in that case only they are not
to have any share.
Section 23 has for its object the prevention of the
mischief liable to ensue be produced, where instead of preventing taking
care of the ships which he has under his convoy
the Commander of a man of war or a squadron convoying ship, employs his ship
in running after prizes in such sort as to risk
the capture of the such Vessels under his convoy or at
any risk to retard their arrival at the place of their
destination. For the prevention of the apprehended mischief,
conduct of this description in question, viz. is moreover "sailing out of his
proper course in purport
"and with the
"view of making prize
of any Ship of Vessel
of the enemy" is marked out for punishment.
And in what consists this punishment? Answer.
In the forfeiting his share in the prize so taken.
