Prize
If then in taking and or securing a prize he acts without
any violation of duty, without any disobedience of the law,
in having of Land Officers Soldier Officers as they are called on board, he sees his
share diminished, diminished in every event in proportion to the number and rank
of such Officers: which and so far as pocket alone is concerned in point of pocket, reputation
of the question, suffers as much as he would by a
forfeiture to the same amount.
But if in taking or securing a price, acting he acts
in disobedience to the law, deserting his convoy the worst that can happen to
him, so far at least as depends upon this Act, (and if no
other punishment or any intimation given by it) –
the worst that can happen to him is not to be a
gainer by his Offence.
But if after trial, or what is much more
and natural, without trial, he escapes conviction
then so far from receiving being suffering punishment for this breach of
which so far from being in a worse plight than those
Sea Commanders were in who having soldiers landsmen on board take a prize without
violation of duty, he is in a better plight.
He has not With him the Soldiers Of the non-offending
Sea Commander the share is not subjected to diminution
by the intervention participation those co-claimants: in the case of the offending Sea Commander
this diminution does not take place.
