Priz3 – Proclamation 31 Jany 1805 analysed.

Preamble Lines 1 to 5. Reference to Order in Council 17 Aug. 1803
for states against which Reprizals were therein made grantable: viz. 1. Italia
Ligurian Republics Lines 5 to 19 – Reference to Order in Council 11 Jany 1805 for
into 26 Line 11 Reprisals granted against 3. the
King of Spain. (N.B. Nothing here said of France or Batavia: only in Col. II, lines
24 to 28, directions herein as to King's armed Vessels shares are extended to France & Batavia.
3. Lines 19 to 26 Desire
to give encouragement to &c
and declaration made of
Kings pleasure to that effect
in Council.
Lines 26 to 53 Donation of prizes to the Taker – Exceptions
and Limitations.

. Exception. Vessels taken by Vessels in the service of Comrs of Excise or
"as herein-after mentioned.
. (Limitation) Duties to be paid are in Merchandize(a). Quere, how
() Quere how is it as to prohibited goods?

. Prizes taken by Privateers shall be disposed of as pleases the Owners &c
& Excise Vessels again excepted.

. Prizes taken by Kings Ships shall go Officer &c on board
at the time of Capture. – Exceptions
1. Conquest Expenditures.
2. – as hereinafter mentioned.

Such prizes may be disposed of by their Agent, after condemnation,
not before. ☞ Confer the Statute earlier – 45. G. 3. c. 72.

IV. Proportions in case of a prize taken by a ship under
command of a Captain.

equal to what would have belonged to them if King's Ships.

XII. Col. III. Lines 1 to 10. Commanders of a Kings Ships shall transmitt
to Navy Board a list of the Officers &c on boat at the time of each capture.

XIII. Lines 10 to 24. Navy Board shall 1. examine such each list, 2. on requext,
certify the truth of it to the Agent – if it agrees with the Muster Book: 3. on
application: give the Agent all necessary lists from the Muster Books: 4. – give him general assistance.
