Prize Acts 1805 & 1809 analysed
Upon this comes the amending Act 49 G. 3. c. 123
and instead of substituting to in the case of the Section
last above mentioned abstracted analysed instead of substituting to it an
amended copy draught leaves it untouched and refers to it,
making at the same time adding to the mass of it its own mass, and perplexing the subject with
a variety of additions and alterations.
1. By the Act of 1805 the person by whom the Prize List is
to be transmitted to the Agent is the Commander of "the
"captured Ship", which Prize List is to contain the
names and so forth of the persons entitled to share therein
meaning in the proceeds of such captured Ship
of which persons it is supposed that the "which Prize list
"shall" (it says) be subscribed by the Lieutenants and
all the signing Officers then on board the Ship": "and
shall contain" (it adds) the names and so forth of the
persons entitled to share therein i.e. in the proceeds
of the ship so captured, being the same Ship on board
of which these Lieutenants and signing Officers are.
Captured Ship? can that have been the meaning?
the Captured Ship and not the capturing Ship? But the on on board the
captured Ship there will be commonly but one or two Officers:
and certainly not the Captain of the Capturing Ship
when there is but one such capturing Ship.
Without any notice taken of this word captured reading, which
at the same time he must have must in his eyes regarded as erroneous
the penner of the corresponding Section in the Act of 1809
employs 0n this same occasion the word capturing.
