Prize Acts 1805 & 1809 analysed

The word "the" being preserved unaltered, unfortunately
by this alteration the matter is not much amended:
perplexity is added to perplexity, and double confusion toil
and trouble is the fruit. "The capturing Ship" – In this expression
is included the intimation that there never is
but one capturing Ship: whereas as everybody knows, and
even the in eight lines after other places even the penner of this Act, ships,
coming each of them with reference to a single prize captured ship under the description of a capturing
ship exist are seen existing in any numbers. By substituting the to the
word the the word each – this perplexity might have
been removed, but "the" and not each is the word is
the word in the Act.

Some lines after, viz. in line 13, comes in a person
viz. the first Lieutenant who is spoken of as being
the "first Lieutenant" of every capturing vessel Ship or
Vessel to which the same (viz. the Prize List which is
to be described by him and others is to be subscribed, relates:
after the same" (continues the Act) shall have
been carefully compared it is *by whom this carefulness
is to be exemplified is not said) with the Muster Books
of every such Ship and Vessel": for so that here again plurality is the plurality
supposition of a plurality is repeated.

Carefully compared! – Had a form been provided for
the certificate, and in that form inserted a declaration
made on the part of each person whose signature is annexed
to it, imparting an assertion of his having "carefully"
performed the comparison in question, here would
have been a groan or two at least a of responsibility the form at least and the injunction
of carefulness thus addressed
to nobody, and insisting
on carefulness on his
part would have have
been an old womanish one. at
