Note that that which captured ship remains unrepeated, is
that both lists are to be sent.

2. Case 3. In line the 9th, the thing to be made
out and delivered and sent to the Agent is "not a
correct and particular list.

Note that if in the consolidating Act of 1805 45 G. 3. c. 72 §. 60 the error if
it be one, consisting in the substitution of the words expression
captured Ship to the words capturing Ship, remains
in the this amending Act of 1809 §. 4 unamended. The
consequence is that if the unamend consolidating Act
be pursued two lists must, at least in the case of a single capturing
ship at least be so made out and delivered, viz
on from by the Commander of the capturing Ship, from which it may be furnished
with the set of signatures required by either Act, and
another from the Commander of the captured Ship, be
from which it can not be furnished with either
of those sets of signatures.
