Prize Acts 1805 & 1809
§.3. Notice of Condemnation
By In Section 66, the Act of 1805, speaking of an Agent
resident in the United Kingdom, ordains that within
six weeks after condemnation in the High Court of Admiralty
notice thereof shall by the Agent be transmitted
to the Treasurer of Greenwich Hospital .... together
with a stock of the property condemned at the time
of such transmission. Penalty, for every neglect
forfeiture of £500 – unless if reasonable causes be , and approved
by the Court of Admiralty are reasonable.
Condemnation? of what? doubtless of a ship
or any part of its contents captured and sued for
as prize. But the ellipsis has left remarkable
enough is the contempt formed by the ellipsis here left,
with the needless and differently worded specifications and variously worded
specifications with which the Act abounds in other
places.
To this 66th Section the of the Act of 1805, the Act of 1809
applies an amendment: and the object of it is to require
that in addition to the communication which as above is required
to be made to the Treasurer of Greenwich Hospital,
and his another such shall be made to the Treasurer
or Paymaster of the Navy.
Of this additional communication good use was thus
intended to be, and as will be seen presently, was afterwards has been
made: the only regret is that instead of ten words, twelve
lines should have been employed in making it.
