Prize Acts 1805 1809 §. 5

The Section goes on and immediately after requiring
the payment to be made to the Hospital Treasurer, requires an account
of receipts and payments on the score of the prize, to be delivered to the same person
the account is to be delivered on auth an oath, together with a duplicate
of the Prize List (the
list of Captors already
required to be delivered
to the Agent by the
Commander) which
had served as the a
ground and authority
for the payments
so made
torn asunder.

Things the most intimately connected are severed
things the most perfectly distinct are forced together in
this Act.

No two operations can be in themselves more distinct than paying
money and delivering in an account of it. Not
only so, but in this particular case the persons to
whom the money is to be paid, and the persons to whom
the account of it such payments is to be delivered are not the same.

After this incongruous addition the number of lines
contained in this Section being still no more than 15
as if for fear of its being too short, the subject of Bounty
money (i.e. head money) is taken up, and the number
of lines thus encreased to 34.

By §. 3 As in early part of the Act, viz. by
§. 8, provision had been made "all regulations herein
"contained" (it is said) "concerning prizes shall apply
"to all cases of bounty money granted by this Act.
After or before a clause to this effect what could be
the effect the good effect of any particular regulation
concerning bounty money? The effect must either be to do Either it does without any
variation What is done already by this general clause regulation
and then the particular one is useless, or to do it with
variation, and then the two clauses contended one another
and uncertainty dispute and litigation are the
consequence.
