Act 1805. §. 49, 50, 51, 70. In these Sections in case of
after one sentence pronounced whether the effect of it be condemnation
or restitution, appe right of appeal is
given to any party grieved, whereupon unless
in particular cases therein stated designated, execution is stayed
for twelve months: if condemnation be the result of
the sentence, sale is thereupon stayed for that time; if restitution
restitution.
Here unless on the one side or the other measures
are taken for dispatch – here is a delay of a twelve
months (what months lunar or calendar?) established
in all cases.
Not that by this delay an Agent as such can
be any gainer: the delay delays by which he is he alone can be a gainer
do not commence take their commencement till the proceeds of the prize or some part of them are
got into his hands, nor consequently till a sale of the
whole or some part of the capture has taken place.
Confronted with the above provisions the contents
of §. 70 of this same Act present a mystery provision not
altogether easy to warrant.
In the compass of less than six lines
it contains two provisions perfectly distinct bearing very little relation to one another, and
the last of them a very material one that seems
to endeavour at least at being a very material one.
