Upon hunting through the 123 sections and contained in 50 pages
that have been filled by are occupied by this Act two cases indeed
may be found viz. one in §. 94, the other in §. 52 in which it is possible that, before
"the time of for Appeal has lapsed" that is to say
before the twelve months allowed for appeal are at an
end, the proceeds of the prize or part of them may
have found their way into his hands.

1. One of these cases is where from the condemning judicatory a certificate has
been obtained certifying that the vessel "sailed under
"the flag and pass of the enemy, or under a commission
"of war granted by the enemy.

For this exception as for almost every other provision
in the Act the discovery of the reason is left to conjecture. But
for one on this occasion the lack of conjecture does not seem
a difficult one: the title of the captors being upon the
face of the transaction above superior to dispute – not subject to
any of those disputes of which an neutral flags are
so prolific – the no valid ground for appeal
can have place.

But in this case if so it be that by sale of proceeds the Agent gets
money into his hands at an early part of the twelve
months why for the whole remainder of the time take any such care to keep it there,
to keep it out of the hands of those the captors to whom it is due?
