What seems remarkable enough, is – that on this
occasion, in requiring distribution or proceeds, no
mention is made of sale – of that operation by but for without
which it is impossible there should be anything to
distribute. Some time or other, before whether it be after
or before the time twelve months allowed provisionally
for appeal is be or be not elapsed, as if it were without need of
sale, or at least without need of any warrant from the
judicatory for the operation of sale, the proceeds are
spoken of, as if they were supposed to have fallen into found their
the Ag as it were by the f way as if it were by the attraction of gravity under the – to have gravitated
found their way into the Agent's hands: – in which supposition
it can not be denied that an order or application
for the distribution of them may be not unreasonable,
"then and in such case" (continues the Act §, 72) on the application
or by the direction of the "Captors "Commander

capture, the proceeds shall be distributed, and an
"order of the Court may be obtained, at his prayer, on
"the Agent .... to distribute the proceeds .... before the
"time of Appeal lapsed, subject nevertheless to the liability

"thereafter during the time limited by law
"for such Appeals".
First In the first place the business, the distribution
is peremptorily to be done: then afterwards means are to
be employed leading to the rendering it practicable: such
is the result of the mass of surplusage enclosed in brackets exposed to view.
