In the case here alluded last spoken of, the capture prize is, in
giving sincerity given placed at the disposal of one of the contending
parties: at the disposal of the claimant, if
his security for value and costs be received: at the
disposal of the Captor if his security for do be received.
In the latter of these cases but in that alone only, can
there be room for the operations of an Agent subject to
the provisions of this Act.† † Examine if so.
In this case the proceeds of the prize may, within ever so
short a time after condemnation and before the twelve
months allowed for Appeal find its their way into the hand pocket
of an Agent. But in this case likewise to what use end, what can be the use
instead of accelerating distribution force him to of the
money, prevent him, during what may be the
great part of the twelvemonth, from paying the it
the money to those to whom it is due?
