Act 1805. §. 87. (Conf. 67.)
In Section 67 was taken up in hand the case where
the condemning judicatory the Court in which the prize has been condemned is the
High Admiralty Court in London: of the case where it
is a Vice Admiralty Court "abroad" (that abroad is being the word)
being mentioned the mention being comprized in a
comparatively short parenthesis, and that for the mere
purpose of requiring fiz "as soon as the same can
be done", the transmission of Accounts and Vouchers.
At the end of an interval of twenty long Sections
comes upon the carpet a case which though differently
expressed seems to be is or is not the same so touched upon in
the above parenthesis viz where the condemning judicatory
is "a Vice Admiralty Court", .... "in any place
out of the United Kingdom.
Had the last of these two Sections been originally penned
by the same hand person as the former or by another person who
in penning this last had kept the former in his mind
there would have been whatsoever difference there would
have been in respect of the provision made in the two cases between case and
case, there would notwithstanding or rather by reason
of such difference a correspondence in the manner
in which the subject was viewed and treated in the
two cases.
As it is it seems but too evident that there
was no such simultaneous view: and that when
the business in the course of the operation called consolidation the two Sections came to beupon different sheets of paper for the purpose of beingtranscribed upon the same
roll the relation what relation the contents of the one might
have to the contents
of the other was a
question that never
presented itself in the
operator's mind.
