1. The first First as to the description given of the cases
in any of which, the exertions exercise powers given to this new
created Office are meant intended to be called forth into exercise.

Where a Prize having been sold, distribution of the
proceeds thereof shall in any respect particular fail of having been made
within the time and in the manner required by the
said Act. In some such words as those the description
given of the case in question would, it should
seem have been, with reference to the presumed intention
compleat as well as correct, and at the same time clear of
surplusage. Instead of this mention is made of the case of an appeal made
brought upon the carpet, and in in the character of eventual consequence of such appeal
two results are brought to view: viz. the lapse
of time for appeal of appealing, without appeal made i.e. the non-existence
of any Appeal within the time allotted for that
purpose, or in case of an Appeal made put in preferred lodged, the abandonment
of such Appeal, "that in all cases" (says
the Act) "where the prizes shall have been sold, and the
"time of appeals shall have lapsed, or if an Appeal
"shall have been lodged, the same shall have been abandoned".
So far so good: but to the alternative
belongs in this case another a third branch which is where
the Appeal having been heard or not heard, the
sentence of condemnation has been affirmed: and it
hardly will be said or thought, that in this third and unmentioned case
the demand for the interpretation of the Officer in question
to the purpose and in the manner in question is less
real than in either of those two mentioned cases the two cases thus above mentioned:
