II. Prize Agents Law Code.
Throughout the whole course of this portion of the
Act, the situation in which the person a person of the class if thus denominated
stand are placed in relation principally and naturally to it is that of a party bound
by it: bound by it, viz. of for the sake and benefit of others, for whom
he acts as trustee.
Sir I Eight Seven Sections whereof six five in the Act of 1805
and two in the Act of 1809 are occupied in providing
for the responsibility, forthcomingness and notoriety to all
such persons as shall take upon them to act in the capacity
here in question.
1. Sect. 53. In This Section, so far as concerns the making Appointments and Sale‡ ‡ In the next Section
§. 54, these are considered
as Agent
simply: i.e. as
Prize Agents for all purposes. a designation is given in
in whereby, in a case in an event there stated which for the exercise of the function here in question
appointment of persons shall be made: viz. in the capture of a prize if the
Flag Officers or Flag Officer appoint an Agent or Agents.
2. Sect. 59. But what if this event does not
fails of taking place? a case tale of things to which in any case instance
it may happen to be realized, and which if there be no
Flag Officer concerned can not but be realized? In this
case theAct is silent the business abandoned to uncertainty
and litigation. Suppose it realized there are four
descriptions of persons indicated by whom each of whom Agents are to be chosen
in equal numbers: viz. 1. Flag Offices. 2. Commanders. 3. Commissioned Officers
and Warrant Officers:
4. Seamen and Marines
who here are
said spoken of as crew
constituting the remainder
of the crew. Of soldiers
of this Section the object
though not indicated
may be guessed at: That
in what way the attainment
of that object is promoted.
2. Sect. 59. In this Section, provision is made respecting
the mode in which the emolument of the Agent
is to be charged. upon the net proceeds In case of prize
money, it is to be charged upon the net proceeds: and so
in case of Bounty Head money under the name of called Bounty Bills,
and Salvage money:
