Section 62, 63, 111, 112, 109

Of this groupe of sections. Of the sections above designated
the declared object is the preventing on the part of
the trustees the fraud, embezzlement, fraud and delay
to the prejudice of the trust fund.

A Of In and by §. 62 the business in the case where the judicatory is a Vice Admiralty Court power is given to the
Judge in the case "where there is no claimant or
"appellant before the Court", at the time of condemnation,
at the requisition of the Captor, to give security
for the faithful distribution of the proceeds, or for
the remitting thereof to the Treasurer of Greenwich Hospital,
or to such persons in England as, under the directions
of the Court, for the purpose of being distributed in
England.

In this Section though the number of lines in it is
not more than 8 cases which require separate provision
have been jumbled lumped together under one directive.

Of The exaction of the security for the faithful distribution, the task exaction
ought not to be thrown as a burthen upon the
Captor in each instance. Finding the security ought
to be a duty imposed upon the Agent of course, to
be performed at the time of his appointment: a security
which so far as concerns that part of the eventual obligation that
rests upon himself alone every such person will
have it equally in his power.

Accordingly for in all cases general purposes, for the exaction of
such security provision is by another Section, already made† † §.
viz to be given at the time of the Agents appointment.
